As of January 1, 2024, the Quality Assurance for Construction Act (Wkb) came into effect for construction works falling under consequence class 1. The government wants construction companies to take more responsibility for the quality of, for example, homes, offices, and bridges. Recognized companies (quality assurors) conduct risk-driven checks on the design and perform inspections during the construction phase to ensure that the building complies with building regulations upon completion. Until now, this has still been the responsibility of the municipality.
If you would like more information about the Wkb or are interested in carrying out a pilot project in consequence class 2 or 3, please contact our office at 076-5607090.
The Wkb is a law that came into effect on January 1, 2024, and shifts the responsibility for the quality of construction works from the municipality to the contractor. This means that contractors must now engage a recognized quality assurer who supervises the construction and is responsible for issuing a declaration of conformity.
A quality assurer is an independent party that supervises the quality of a construction project. The quality assurer checks whether the construction work complies with the requirements of building regulations and other relevant legislation.
A quality assurer is mandatory for all new construction projects that fall under consequence class 1. This includes ground-level homes, small utility buildings, and pedestrian bridges. It is expected that this will also apply to more complex objects starting in 2029.
The Wkb aims to improve the quality of construction works and reduce the number of building defects. The law should also lead to more efficient and faster construction processes where the responsibility and liability of the involved parties are clearly regulated.
You should engage a contractor who will (if necessary) engage a recognized quality assurer. The contractor will inform you about the further steps in the process. You can also engage a quality assurer yourself.
You have the right to expect a construction of good quality that complies with laws and regulations.
You must engage a recognized quality assurer and conclude a written agreement with them. The quality assurer will supervise the construction and perform the necessary checks.
You are obliged to deliver a construction of good quality that meets the requirements of building regulations. You are also liable for defects in the construction for ten years.
